Terms of use
These terms are an agreement between you and Gemini Realty Management LLC (“we”, “us”) for the Logbird app and service. By using Logbird you agree to them. Our privacy policy explains how we handle your data.
1. What Logbird is, and is not
Logbird helps you keep a record of the miles you drive and the tolls and parking you pay, and prepares that record for your taxes. It is a record of mileage, not tax advice. You, or your tax preparer, are responsible for what goes on your return, including whether a trip is deductible and which rate applies. Review your log before you rely on it.
Automatic detection depends on your phone, its settings and the operating system, which can stop apps running in the background. Logbird may miss a drive, start or end one late, or record one inaccurately. Check your trips, add any that are missing, and correct distances where needed.
2. Your account
You must be 18 or older and able to agree to these terms. Keep your sign-in secure; you are responsible for activity on your account. You can delete your account at any time in the app (Settings › Your data › Delete account).
3. Subscriptions and free trial
- Logbird is a paid subscription, $5.99 a month or $45 a year, with a free first month for new users. Prices are confirmed in the app before you buy.
- Subscriptions are bought through your Apple ID and renew automatically at the end of each period unless you cancel at least 24 hours before it ends.
- Manage or cancel in your Apple ID's Subscriptions settings. Refunds are handled by Apple under its policies.
- If your subscription ends, your records stay in the app and can still be viewed, classified and exported, but new tracking and new entries are paused until you subscribe again.
4. Your data
Your trips, records and photos are yours. You give us permission to store, process and display them only to provide Logbird to you, as the privacy policy describes. You are responsible for the content you add.
5. Acceptable use
Don't misuse Logbird: no attempts to access other people's data, interfere with the service, reverse engineer it except where the law allows, or use it for anything unlawful. Don't use the app in a way that distracts you while driving; it is designed to work without you touching your phone.
6. Changes and availability
We may change or improve Logbird and may update these terms. If a change is material, we will tell you in the app before it takes effect. We may suspend or end access for a serious breach of these terms. We aim to keep Logbird available but cannot promise it will always be uninterrupted or error-free.
7. Disclaimers and liability
To the extent the law allows, Logbird is provided “as is”, without warranties of any kind, and we are not liable for indirect or consequential losses, including tax penalties, interest or lost deductions arising from your use of the record. Our total liability for any claim is limited to the amount you paid us for Logbird in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.
8. Governing law
These terms are governed by the laws of the State of North Carolina, United States, without regard to conflict-of-law rules.
9. App Store terms
- These terms are between you and us, not Apple. We, not Apple, are responsible for Logbird and its content.
- Your licence is non-transferable and limited to using Logbird on Apple devices you own or control, as the App Store Usage Rules allow.
- Apple has no obligation to provide maintenance or support for Logbird.
- If Logbird fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation.
- We, not Apple, are responsible for claims relating to Logbird, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims.
- You confirm you are not in a country subject to a US government embargo and are not on a US list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
